Patent position and potential infringement for a Bentley 60 cylinder head design.

BENTLEY 60. CYLINDER HEAD.

With reference to the patent position of the head design shown in drawings E.CD.403/4, E.CD.525 and E.CD.536 recently sent to us for investigation, we have made a search and discovered a number of patent specifications, some of which have a close bearing on the design in question. We send these herewith for your inspection.

We already have a Provisional Patent Application on file, (Application No. 28240/37) for this design and we are taking steps to complete it.

Two questions arise for consideration :-

1) Will our construction infringe any of these Patents ?

2) Will any of them prevent us getting a Patent ?

In our view the only Specifications which it is necessary to consider are 280544, 303592, 319810 and 349460. We will deal with these in order.

280544 will clearly not stand in the way of our getting a Patent since the inlet valve is not inclined, but this would appear to be a Master Patent and there is a question therefore whether we infringe the Claims. In our view we shall not infringe the Claims.

These Claims refer to three separate parts, the cylinder proper, a lateral combustion chamber, and a constricted port or passage connecting the cylinder and lateral combustion chamber. The inlet valves are to be fitted in the cylinder proper in Claim 1 and in a part of the cylinder head which is approached closely by the piston, in the second Claim.

In our case the inlet valves are situate either in a lateral combustion chamber or at least in the constricted port leading to it.
