Letter from Super Oil Seals Limited regarding a dispute over the incorrect supply, delivery, and performance of various oil seals.

It was definitely agreed that such damage was bound to occur; and the writer requested that no more Seals of the sizes affected should be used and offered to exchange free of charge all the existing stock to Seals of the correct sizes, although we were not in any way responsible for the error. The writer was told this could not possibly be done as no change could be made until tests had been carried out on the correct size Seals.

We supplied to you within two days three dozen new Seals of the correct dimensions - these Seals we are informed were not received by you and a further three dozen were sent on June 29th. The writer called upon you early in July and was informed that this second set had not been received by you either, although later investigations revealed that you had acknowledged safe receipt in a letter dated June 30th.

Later in July the writer was given two entirely contradictory reports (1) that the whole of the Seals had been sent to France for test and you were awaiting the report (2) that the Seals had not been received and the Report re French test was inaccurate; this latter doubt persisted, as instanced by our letter to you dated August 10th.

The whole position is apparently very confused and renders it extremely difficult for us to give you the assistance we are most anxious to place at your disposal.

Regarding Seal No. 20616, the undersigned was instructed by Mr. Bailey in the presence of Mr Mills that this Seal No. 20616 must be supplied and not Seal No. 206112 - the former being for a 1.3/32" shaft and the latter for a 1&3/8" shaft; we are therefore acting under these instructions which are also embodied in your letter dated the 9th inst., but we must ask you to particularly observe that we cannot possibly accept any responsibility whatsoever in respect to the functioning of, damage to, or any consequential damages arising from the use of this Seal No.20616 or the other two sizes viz: 1751 and 1831; and we must also request you to give us a written assurance that you accept delivery on this express understanding and absolving us from all responsibility.

We venture to hope that at an early date you will find it possible to change over to our recommendations.
