Letter to John Marston Ltd. regarding responsibility for repair work on faulty oil coolers.

Dear Sirs, With reference to your letter of 10th. inst. regarding repair work on oil coolers to E.87820. We regret that you are not correct in assuming that the writer has agreed in principle with the charges shown on the statement attached to your letter. As expressed to Mr.Dunn on several occasions, the writer's opinion on this subject is as follows:- (a) In the case of the first hand soldered coolers, the failure with this cooler is attributable to bad workmanship taking the form of bad soldering on the part of Messrs. Marstons; and secondly to the fact that the tube bulges did not fit the plates correctly. We consider, therefore, that the responsibility for the defectiveness of these hand soldered coolers is yours and that the cost of correcting them should be met by you - the writer's recommendation as a compromise, however, was that we should pay for the new tubes, and 50% of the labour cost involved. (b) In the case of dip soldered coolers, the position is different since these coolers were made correctly and the workmanship, etc. could not be complained of, although again the trouble of the tube bulges not fitting the tube plates has occurred. In the case of these coolers, therefore, the writer is prepared to agree that the responsibility is ours and to agree the charge enclosed in your letter, namely 11/9 1/2d. per cooler. | ||
