1029. (Experimental Dept.) Rm{William Robotham - Chief Engineer}/AFM{Anthony F. Martindale}5/R.{Sir Henry Royce} 30th November, 1938. Bendix Ltd., Tysley, BIRMINGHAM. (For the attention of Mr. O.{Mr Oldham} McFarland). Dear Sirs, Your Ref: OM/EM. We thank you for your letter of the 25th November. The matter we were going to discuss with Capt. Irving is as follows:- We are proposing to use the brake the brake operation unit shown on the enclosed drawing. Capt. Irving informed the writer that he had certain patents concerning hydraulically-operated wedges, and these we have examined. We are advised by our Patent Agents that our drawing SCD.1039 does not constitute an infringement of your patents, because the points of similarity between your patents and your scheme were originally patented by a third party in 1924, and are now void. The original idea of our scheme SCD.1039 occurred to us in 1934 before the application date of your patents, and our early drawings are of this date. We should be pleased to learn what your attitude is in this matter. Yours faithfully, For ROLLS-ROYCE LTD. | ||
