Grylls c/o Rolls-Royce Limited Derby, England Dear Sir: At the request of Mr. Frank Schubert I am sending you herewith a copy of the United States patent application which was filed November 22, 1934, to cover his invention in the lubrication of Bearings, and which I understand you discussed with him during a recent visit to the United States. The immediate question is whether or not to file application for British patent. As the United States patent is expected to issue in the near future, the British application must be filed promptly if it is to be filed at all. Such British application cannot be filed under the International Convention because more than one year has elapsed since the United States filing date. It could be filed as a "communication" to your British Patent Agent, however, unless the issuance of a valid patent is barred by public use or publication of the invention in England. Mr. Schubert is not sure whether or not this invention has been in public use in England by reason of the shipment of "Packard 120" automobiles having certain bearings constructed in accordance with the invention, but he thinks that you can easily determine this point in conference with your solicitor. Should you determine that a valid British patent can probably be obtained, Mr. Schubert would like to have your solicitor file a communication application in his behalf in order to get it in before the United States patent issues.
