Rolls-Royce Ltd., Nightingale Road, Derby Dear Sirs, It will be known to you that for some time litigation has been proceeding between the Patentees of the Autovac apparatus and a Mr. Pyman on the subject chiefly of the infringement of the master Patent 12835/11 embodied in the Autovac Vacuum Feed Apparatus, by the manufacture and sale of the Gray-Vac apparatus. The Defence challenged the validity of the said master patent. They also denied infringement. Mr. Justice Russell gave his judgments in the matters recently, and whilst affirming the validity of the Autovac master patent, held the Gray-Vac apparatus not to infringe the same. This judgment is subject to appeal to the Appeal Court and to the House of Lords, and we hereby give you notice of our intention to lodge appeal against the said judgment, and it is therefore important for manufacturers to bear this fact in mind, as, should the judgment be upset they would be liable for any infringement of the said Patent by the use of the Gray-Vac apparatus about which complaint is made.
