GUARANTEE AND TERMS OF BUSINESS Frazer-Nash-B.M.W cars as supplied by A.F.N. Limited (hereafter called “the Company”) are sold with the following express Warranty which excludes all warranties, conditions and liabilities whatsoever implied by Common Law Statute or otherwise, that is to say:— In the event of any defect being disclosed in any part or parts of the goods and if the part or parts alleged to be defective are returned to the Company’s Works carriage paid within six months from the date when the goods are delivered new to the retail customer the Company undertakes to examine same and should any fault due to defective materials or workmanship be found on examination by the Company it will repair the defective parts or supply free of charge a new part in place thereof. All labour charges incurred in dismantling and re-erecting cars or chassis shall be borne by the Purchaser. This Warranty is limited to the delivery to the Purchaser free at the Company’s Works of the part or parts whether new or repaired in exchange for those acknowledged by the Company to be defective. The Company gives no warranty except as herein stated but desires and expects that customers shall make a thorough examination before purchasing. For the purpose of this Warranty the term “goods” means and includes new cars or chassis or parts thereof including replacement parts supplied by the Company. It does not include tyres, speedometers or electrical equipment or other proprietary articles or goods (including coachwork) not of the Company’s own manufacture although supplied by the Company. Proprietary articles are covered by the warranty (if any) given by the separate manufacturers. On second-hand goods no warranty is given by the Company or is to be implied. The Company’s responsibility is limited to the terms of this Warranty, and it shall not be answerable for personal or fatal injuries or consequential or resulting liability damage or loss arising from any defects. This Warranty shall not apply to defects caused by motor racing, competitions, trials, wear and tear, misuse or neglect or to the defects in any goods which have been outside the Company’s Works, or which have been let out on hire or the identification numbers or marks on which have been altered or removed. This Warranty is dependent upon the strict observance by the Purchaser of the following provisions :— (a) The Purchaser shall at the time of purchase personally sign the card supplied by the Company and register his name, address, date of purchase price paid and car and chassis numbers and name and address of Seller with the Company and may obtain if he so desires from the Company a signed copy of this Warranty. This Warranty shall not be assigned or transferred to anyone unless the Company’s consent in writing has first been obtained. (b) The Purchaser shall send to the Company’s Works such part or parts as are alleged or claimed to be defective promptly on the discovery of the claimed defect together with such other parts as the Company may subsequently require. Transportation is to be prepaid by the Purchaser and said part or parts to be properly packed for transit and clearly marked for identification with the name and full address of the Purchaser and with the car and chassis numbers of the vehicle from which the said part or parts were taken. If parts are ordered without mentioning that they are required as free replacements under guarantee they must be paid for in all cases and claims made after the new parts have been supplied will not be entertained. (c) The Purchaser shall post to the Company at its Works on or before despatch of such part or parts alleged to be defective a full and complete description of the claim and the reasons therefor. (d) The judgment of the Company in all cases of claims shall be final and conclusive and the Purchaser agrees to accept its decision on all questions as to defects and to the exchange of part on the expiration of six days from the despatch of notification of its decision the part or parts submitted may be scrapped or returned carriage forward by the Company. Repairs and overhauls carried out by the Company are warranted for three calendar months from the date of completion thereof in respect of material and workmanship supplied and done by the Company except in the case of material which is not of the Company’s manufacture. This Warranty as to repairs and overhauls is in lieu of and to the exclusion of any Common Law, Statutory, express or implied condition, warranty or guarantee and the Company’s liability is limited to the doing of any further work or the supplying of any further material which may be necessary to make good defects for which the Company is liable under the terms of this Warranty. In no case will the Company be responsible to the Buyers or to anyone else for expenses incurred on repairs or adjustments executed without the express written permission of the Company. Prices and specifications, components, etc., mentioned in this catalogue and/or any other literature issued by the Company are subject to alteration without notice, and all orders are accepted for execution at the price ruling at date of order. Illustrations in this catalogue are given as a general guide only to purchasers and are not binding as to details. Delivery is at our Works, Isleworth, Middlesex. The Company will do their utmost to give delivery by the arranged date, but all orders are accepted without guarantee in this respect and the Company accept no liability for failure to deliver. In case of goods going abroad, inspection, examination, checking or testing (where practicable) of such goods or the parts must be made at our Works as no claims in respect of shortage or fault in such goods or packing will be sustainable or entertained after they leave our Works. The term “Agent” is used in a complimentary sense only and those firms whom we style our Agents are not authorised to advertise, incur any debts or transact any business whatsoever on our account other than the sale of goods which they may purchase from us; nor are they authorised to give any warranty or make any representation on our behalf other than those contained in our Guarantee. 16 “THE FINEST TOURING CARS IN THE WORLD” Only if you have driven one of these cars over pavé and atrocious road surfaces in comfort and without needing to reduce your speed; toured in the Alps, which to be enjoyed demands really efficient cooling, high gear ratios and the lock of a London taxi, or cruised effortlessly at over 80 m.p.h.—not for a mile or so of arterial road, but on autobahnen hundreds of miles in length (those wonderful motoring roads that are so much less enjoyable if one is forced to travel at what is relatively a crawl because of fears of mechanical trouble), can you fully realise its superiority in engine and chassis design over the ordinary touring car. Most people take their cars abroad to-day, and ownership of a Frazer-Nash-B.M.W. would tempt you to do so, but if not it will still be obvious that a car designed and built for these much more severe climatical and geographical conditions will result in the absolute maximum of driving pleasure, mechanical reliability and long life under less severe conditions. Moreover, you can find some very bad stretches of road at home and “colonial” conditions off the beaten track to enjoy its perfect suspension, with long cross-country journeys and tours in mountainous districts to demonstrate its capacity for putting up high average speeds, its climbing capabilities and tremendous reserve of power. “Frazer-Nash-B.M.W. motoring” means remarkable road-holding and cornering, particularly evident on wet or greasy surfaces; a degree of riding comfort so exceptional even over the roughest surfaces as to set a standard by which other cars are judged; perfect steering; an unbelievably smooth engine without the semblance of a “flat-spot” throughout its speed range; high cruising speeds by virtue of its exceptional power-to-weight ratio and high gears; vivid acceleration; an outstanding top-gear performance; ease of maintenance and economy in running expenses with “aero-engine reliability.” Our own enthusiasm, equalled by the enthusiasm of our owners, is based on the incontrovertible fact that you could not wish for, neither would it be possible to find, a better car. 1 | ||
