Answering your D/BP/HF{H. W. Frost - Coachwork Inspector}1/B4.1.23 we are in agreement with Mr. McKinnon's remarks ECM/GGW of 10.11.22, that examination of the cells indicated nothing for which the Exide Company could be made responsible, i.e. there were no signs of failure by buckling and short circuiting of the plates.

The reason for taking 50% of the responsibility on ourselves was that we know that in some of the earlier batteries sent out the first charge instructions issued by this Dept. to the Test Dept. were not properly carried out, and the battery may have failed a little prematurely in service due to this cause.

As regards the customer's share of the responsibility, this as you will remember was brought about by the fact that the Chloride Co's agents misinformed the customer re the failure of the battery, saying it was due to the high charging rate of our dynamo, but as you may know, it has been subsequently agreed by the Exide Company that this was a mistake on their part. It was for this reason that we suggested that the customer's share of the responsibility might be transferred to the Exide Company. If the latter will not accept this, then the customer must be asked to pay.
