TERMS AND CONDITIONS. THE MANAGING COMMITTEE OF THE SOUTH EASTERN AND CHATHAM RAILWAY COMPANY GIVE PUBLIC NOTICE:— 1.—That, unless expressly otherwise agreed, all Rates for the conveyance of Motor Cars are exclusive of Customs, Excise, Government Duties and Taxes, Stamps and other customary Incidental Expenses. 2.—That, in respect of Motor Cars accepted by them for conveyance by Sea, they shall be exempted from any liability for any Loss, Damage or Delay which may arise during transit from an Act of God, the King's Enemies, Civil Commotion, Fire, Explosion, Accidents from Machinery, Boilers or Steam, and all and every Dangers and Accidents of the Sea and Navigation of whatever nature and kind soever, in the same manner as if the Managing Committee had signed and delivered to the Consignor a Bill of Lading containing such conditions. 3.—That they will not be responsible for any Loss, Damage or Delay, except upon proof that such Loss, Damage or Delay was occasioned by the neglect or default of the Managing Committee or its Servants, unless an extra premium for Insurance against such risks has been paid. The Managing Committee will not in any case be liable for any indirect or consequential damages. No claim for Damage or Delay will be allowed unless made within three days after delivery, nor for Loss unless made within seven days after the date on which delivery should have taken place. The Managing Committee will not bind themselves to forward any Motor Car by the first necessary boat. 4.—That they do not accept for conveyance Motor Cars charged with electricity (except as regards the small electric battery and coil usually affixed to petrol-propelled Motor Cars), or with gas, oil or other inflammable liquid or vapour. Any person consigning a Motor Car so charged will (in addition to being subject to a penalty of £20) be held liable for any Loss or Damage that may happen or be occasioned thereby, or by reason thereof, and the Managing Committee will not be liable for loss of or damage to the Motor Car under such circumstances.
