Wolseley's have already specified in their correspondence certain features in R.R. design which are unpatented but which they agree not to incorporate in Wolseleys design for 5 years.

You should settle which features are with Mr. McCormack.

If you can persuade Mr. McCormack that there are certain other features or combination of features which in our opinion are novel, he will agree on behalf of Vickers and Wolseley not to incorporate these features or combination of features in any aero engine made or offered for sale by Vickers or Wolseley for 5 years, subject to this clause not being operative if subsequently Vickers or Wolseley discover that, at the time R.R. thought they had found something new, it had already been previously discovered and subject to Vickers and Wolseley being able to prove the facts.
4. Wolseley's will provide the material to R.R. specification and will agree that the material shall pass the same tests as those to which R.R. material is submitted failing the material passing such tests, the material shall not be used in the manufacture of R.R. engines.

Wolseley's agree that the first engine made by them shall be submitted to the same destructive tests of reverse stressed as the first engine made by the R.R. in any series in which there have been alterations made are submitted.
